The good news is that Delta 8 is legal in Pennsylvania due to the state’s adherence to federal law. In the 2018 federal Farm Bill all hemp products were made legal if they had less than 0.3% Delta 9 THC in them. So, if the Delta 8 product is derived from a hemp plant and contains no more than 0.3% Delta 9 THC it is completely legal. There are no restrictions on milligram strength, product type, or possession amount. This means that Pennsylvanians whether they live in Philadelphia, Pittsburgh, Harrisburg, York, Reading, Wilkes-Barre, Allentown, Scranton, Hershey, Lancaster, West Chester, Gettysburg, Norristown, Erie, or anywhere else in the state can enjoy Delta 8 products as they choose.
