The good news is that Delta 8 is legal in Virginia due to the state’s adherence to federal law. In the 2018 federal Farm Bill all hemp products were made legal if they had less than 0.3% Delta 9 THC in them. So, if the Delta 8 product is derived from a hemp plant and contains no more than 0.3% Delta 9 THC it is completely legal. There are no restrictions on milligram strength, product type, or possession amount. This means that Virginians whether they live in Richmond, Virginia Beach, Chesapeake, Norfolk, Roanoke, Arlington, Newport News, Hampton, Williamsburg, Lynchburg, Alexandria, or anywhere else in the state can enjoy Delta 8 products as they choose.
